Terms of use – Halvik apps and games
1. Publisher and definitions
- The publisher and seller of Halvik apps and games (the App) is ABG Grzegorz Oleksa (sole proprietorship), ul. Miła 6, 41-500 Chorzów, Poland, tax ID (NIP) 6341173710, REGON 276985588 (the Publisher). Halvik is a brand of the Publisher.
- Contact: [email protected], phone +48 455 574 020.
- These Terms apply to Manewrownia – an app for learning harbour manoeuvres with a sailing yacht and a catamaran (on Google Play and at halvik.pl/aplikacja/). When the Publisher releases further Halvik apps or games, they will be added to these Terms.
- A User is anyone using the App. A Consumer is a User who is a natural person using the App for purposes not directly related to their business or profession.
2. Rules of use
- The App requires a device with a current Android version or a current web browser. An internet connection is needed on first launch; after that the App also works offline.
- The App does not require an account.
- The App is educational. It shows manoeuvres in a simplified way – every yacht handles a little differently. The App does not replace training or practice on the water with an experienced skipper. The skipper or helmsman is always responsible for the safety of the vessel and crew.
- Copying, distributing, decompiling or modifying the App beyond what the law allows is prohibited. The App, its graphics, animations and texts are protected by copyright and belong to the Publisher.
3. In-app purchases
- Some lessons are free. The full version is a one-time purchase in the App from Google Play: for a monohull yacht, for a catamaran, or a bundle of both. It is not a subscription. The gross price is shown before purchase.
- Purchases in the App downloaded from Google Play are processed and settled by Google Play under the Google Play terms. The Publisher does not receive card or other payment details.
- A purchase is linked to the User's Google account and works on every device with that account, also after reinstalling.
- A Consumer buying digital content not supplied on a tangible medium loses the right of withdrawal if performance has begun with their express consent before the end of the withdrawal period and after being informed of the loss of this right (Polish Consumer Rights Act, Art. 38(1)(13)). Refunds on Google Play are also handled by Google under its policies.
4. Complaints
- The Publisher is liable to Consumers for the conformity of digital content with the contract under the Polish Consumer Rights Act.
- Complaints can be sent to [email protected]. Please describe the problem and – for purchases – give the Google Play order number.
- The Publisher responds to complaints within 14 days of receipt.
- Consumers may use out-of-court dispute resolution, e.g. help from a municipal or district consumer ombudsman in Poland.
5. Liability
- The Publisher makes efforts to keep the content of the App correct.
- The Publisher is not liable for the consequences of decisions made solely on the basis of the App, including damage during manoeuvres on the water, subject to item 3.
- This section does not exclude or limit the Publisher's liability to Consumers where the law does not allow it, nor liability for intentional damage.
6. Personal data
See the Privacy policy of Halvik apps and games.
7. Final provisions
- These Terms are available free of charge at halvik.pl/en/terms/.
- The Publisher may change these Terms for important reasons (e.g. changes in law, new features or new apps). Changes are announced on this page and do not affect rights acquired before they take effect.
- These Terms are governed by Polish law. This choice of law does not deprive Consumers of the protection of the mandatory laws of their country of habitual residence.
- This English version is for information; in case of discrepancies the Polish version prevails.
